▢ 서 론
Ⅰ. 연구 배경
최근 소셜 네트워킹 서비스(Social Networking Service, SNS) 분석에서 의료소비자의 보건의료 안전에 관한 관심분야는 양악수술, 임플란트, 시력교정술, 치과교정술, 보톡스 코성형술, 프로포폴 마취, 필러시술, 리프팅, 문신술 등의 순으로, 대부분 비급여 의료서비스 진료분야와 미용성형에 관련된 것이었다(김수경 등, 2013). 미용성형에 관한 사회적 관심이 높아지고 성형수술(시술)로 인한 환자의 사망 사고 및 심각한 부작용 사례가 지속적으로 보고되면서 보건의료 안전문제에서 미용성형수술의 안전관리가 중요하게 대두되고 있다. 그러나 미용성형수술은 질환의 치료 및 신체 기능향상을 위한 필수 의료행위에 포함되지 않아 건강보험에서 급여되지 않는 관계로 현황과 실태 파악이 어려운 실정이다. 또한, 미용 목적의 성형수술은 소규모 의원급 의료기관에서 주로 시행되고 있어 안전 문제가 사회적으로 제기되고 있는 것에 비해 안전관리체계가 상대적으로 취약할 수 있다. 이에 2014년 9월, 보건복지부에서는 성형외과 진료를 시행하는 의원을 대상으로 실태조사를 실시하고 수술환자의 권리보호와 안전관리 강화를 위한 대책방안을 마련한 바 있다(보건복지부, 2015.2.11.).
보건의료의 질 향상과 안전관리를 위하여 많은 나라에서는 법률적 규정 외에도 가이드라인을 개발하여 활용하고 있고 세계보건기구(World Health Organization, WHO)에서도 수술의 안전을 도모하기 위한 가이드라인을 제시하고 있다. 국내 의료기관 인증평가제도는 병원급 이상의 의료기관을 대상으로 인증에 필요한 기준의 일환으로 수술과 관련된 일반적인 기준과 가이드라인을 마련하여 준수하도록 하고 있다. 그러나 성형수술의 경우 인증평가 대상이 아닌 의원을 중심으로 이루어지고 있는 관계로 인증 제도를 통한 관리에서도 제외되어 있다. 따라서 미용 목적의 성형수술이 주로 이루어지는 의원급 의료기관을 대상으로 그 기능, 인력, 기관규모 등을 고려하여 적용 가능한 수술 안전 가이드라인을 마련하는 일은 환자 안전을 위한 노력을 견인하기 위한 기초가 될 것이다.
Ⅱ. 연구 목적 및 방법
본 연구에서는 미용 목적의 성형수술(시술)에서 의료이용자의 안전을 제고하기 위하여 의료기관에서 이루어져야 하는 노력을 중심으로 기준 및 가이드라인을 마련하고자 하였다.
이를 위하여 본 연구에서는 구득가능한 자료를 중심으로 의원에서 이루어지는 수술 현황 및 성형외과 의원의 규모를 중심으로 현황과 추이를 살펴보았다. 그리고 성형수술의 관리와 관련된 해외 법령과 가이드라인을 수집하여 국가별로 특성을 비교하였다. 국가별로 의료체계에 차이가 있으나 가급적 비교가 가능하도록 동일․유사 항목으로 분류하여 비교하였다. 또한 우리 사회의 관심사를 반영하여 미용성형수술 관련 인력(자격요건 등), 시설(수술실 표준 등), 대상(미성년자, 정보 제공 및 동의), 의료광고 및 손해배상 등을 항목으로 반영하였다.
의원에 적용가능한 성형수술 안전 기준 및 가이드라인을 마련하기 위하여, 2009년에 대한성형외과학회에서 마련한 성형수술 환자를 위한 환자안전 권고문을 기반으로 세계보건기구에서 제시한 ‘수술 안전을 위한 가이드라인의 개발방법’을 참고하여 총 8단계의 수용․개작 과정을 진행하였다. 각 단계별로 구조적 문헌고찰, 전문가 설문조사, 유관기관 의견수렴, 토론회 등의 방법을 활용하였다. 구조적 문헌고찰을 통하여 선정된 문헌을 토대로 수술 진행과정과 수술환자의 안전범주를 구분한 가이드라인 초안을 구성하였고 각 임상전문학회에서 추천받은 10인의 자문위원의 내용검토와 합의를 통해 최종안을 마련하였다. 이 과정에서 의원급 의료기관의 적용 가능성을 높이기 위하여 개원의들을 대상으로 가이드라인 항목에 대한 수용성 조사를 수행하였다. 최종 가이드라인(안)은 참여 학회별 의견수렴 절차를 밟았다. 마련된 성형수술 안전 가이드라인의 활용방안을 위해 토론회를 개최하여 이해관계자들의 의견을 수렴하였다.
▢ 수술 및 성형외과 의원 시설인력 현황
Ⅰ. 수술 현황
건강보험 청구자료를 이용하여 급여대상 수술 및 전신마취 수술 현황을 살펴보았다.
2010년부터 2014년 동안 수술 청구건수는 점차 증가하였으며, 그 중 의원 청구 비중은 약 50%로 의원의 점유율은 소폭으로 감소하였다. 의원 수술의 38~39%는 안과에서 청구되었으며 정형외과 12%, 일반 12%, 외과 9%, 산부인과 7% 순이었다. 개원한 의원의 약 75%에서 수술 건 청구가 있었다.
전신마취 수술의 청구는 2014년 1,343,641건으로, 이중 3차 의료기관 35%, 종합병원 31%, 병원 25%, 의원 9% 순의 점유율을 보였다. 의원 중 전신마취수술을 청구한 기관은 2,240개소로 8%만이 해당하였고 연평균 청구건수는 50~70건이었다. 의원 전신마취수술 청구의 60%이상은 산부인과가 차지하여 압도적이었고 일반 11%, 정형외과 10%, 이비인후과 9%, 외과 6% 순이었다.
Ⅱ. 미용성형수술 및 시설 인력 현황
국제미용성형외과협회의 성형수술통계(2014년)에 따르면 우리나라의 미용성형수술건수 는 연간 약 44만 건이고 미용시술건수는 연간 약 54만 건으로 추정되었다. 상안검성형술을 포함한 안면 및 두경부 수술건수가 34만 건으로 가장 많았고 미용시술은 보톡스 시술이 27만 건 이상으로 가장 많은 것으로 조사되었다.
건강보험심사평가원의 요양기관 현황자료에 따르면 2014년 839개소의 성형외과 의원 중 85%인 716개소는 1인 의사에 의해 운영되고 있었다. 간호인력은 간호사 337명, 간호조무사 1,711명이 근무하고 있었고 기관당 의료인은 평균 2.4인이었다. 수술실이 있는 의원은 253개소, 회복실은 236개소였고 입원실을 구비한 경우는 129개소로 17%였다.
▢ 국가별 미용성형수술(시술) 규정 및 관리 방안
Ⅰ. 프랑스
프랑스는 미용성형 관련 법령이 2003년 제정되어 운영되고 있다. 프랑스에서는 성형외과 수술 및 시술을 시행할 수 있는 의사는 성형외과 전문의 및 타과 전문의 또는 타과 전문의면서 성형수술 자격이 있는 의사로 한정하고 있다. 성형수술을 시행할 수 있는 전문과는 한정되어 있으며 협회 명부에 기재된 의사의 전문분야에 한해서 미용 수술을 시행해야 한다. 시설은 HAS(Haute Autorité de santé) 인증을 받아야 하며, 시설 구획 및 공간구성, 관찰실, 시설에 대한 장비 규정 등이 법률에 명시되어 있다. 환자는 상담일로부터 최소 15일 뒤에 수술 결정을 내려야 하며, 숙려기간을 줄일 수 없다. 환자를 만난 외과 의사는 예정된 수술의 전체 과정이나 일부 과정을 집도하지 않을 때에는 환자 와 상담할 때 그 사실을 알려야 한며, 이 내용은 견적서에 표기되어야 한다.
Ⅱ. 싱가포르
싱가포르 주요 의학회에서 2008년부터 ‘미용 시술 의사들을 위한 가이드라인(Guidelines on aesthetic practices for doctors)’을 제정하여 실행하고 있다. 싱가포르는 미용 시술 및 수술을 과학적 증거에 입각해 리스트 A, B 두 가지로 분류하여 시술의 종류에 따라 최소한의 능력요건, 시술이 행해질 수 있는 적합한 환경, 사전 시술 요구 횟수를 정하고 있다. 리스트 A는 과학적인 근거수준이 높은 경우 또는 시술이 잘 정립되어 용인될 수 있다는 의료전문가들의 합의가 있는 경우이며, 리스트 B는 근거수준이 낮거나 시술이 정립되지 않고 용인될 수 없는 것이라는 의료전문가들의 합의가 있는 경우이다. 리스트 A에서 침습의 정도가 높아질수록 외과 또는 성형외과로 시술자를 제한하고 있으며, 시설 환경은 일반 클리닉 수준에서 수술장이 반드시 마련되어야 하는 것으로 정하고 있다. 환자에게는 적절한 비용청구를 하도록 하며, 리스트 B에 포함된 시술을 광고하는 것은 금지되어 있다.
Ⅲ. 영국
영국은 미용성형수술(시술)에 대해 권고안을 통해 인력 및 시설 등을 규정하고 있다. 현재 영국 내에서 수술(시술) 의사의 법적인 조건은 5년의 의과대학 과정과 일종의 인턴수련인 F1과정을 완료한 의사이다. 가이드라인에는 수술(시술)인력의 전문성을 위해 성형외과학회, 이비인후과, 구강악안면외과, 안과, 유방수술, 부인과학을 포함한 전문가 단체와 학회 대표로 구성된 미용성형 다학제위원회(Cosmetic Surgery Inter-specialty Committee)를 설립할 것을 권고하였다. 미용성형수술을 수행하는 기관은 일반 의료기관과 같이 The Care Quality Commission(CQC)에 시설 및 수행하는 행위를 반드시 등록해야 한다. 미용 시술과 관련된 광고는 모든 미디어의 광고를 규제하고 있는 광고표준위원회(Advertising Standards Authority, ASA)에 의해 동일하게 규제되고 있으며, 미용성형수술 및 시술과 관련하여 오해의 소지 및 부당한 광고에 대한 기준을 제시하고 있다.
Ⅳ. 호주
호주 정부는 2009년 국가 전문의 등록 및 승인제도를 도입하였으며, 이 후 미용성형 분야에 대한 분석 및 규제를 위해 공식문서인 “미용성형 의료 및 시술 절차 : 국가적 체계화에 대한 최종보고서“를 발표했다. 호주의 미용성형 의료 및 시술에 있어 "Good Medical Practice: A code of conduct for doctors in Australia"의 개발을 통해 인력에 대한 규제를 강화하였으며, 미용성형 이후 사후 처리에 대한 책임 의무화를 규제화 하였다. 또한, 미용성형 시설에 대한 권역별 라이센스제도를 통해 시설규제를 강화 하였으며, 환자들에게 가이드라인 및 권고문을 통한 의무 및 책임을 부여하고 광고 및 손해배상에 대한 법적 규제를 강화하여 미용성형 산업을 의료적 분야로의 인정을 위해 노력하는 모습을 보였다. 그러나 인력, 시설의 규제는 전문의 등록 및 승인제도를 통해 등록된 의료인에게 해당하는 내용들로 미등록 의료인에 대한 규제가 아직 미흡한 상태임을 명시하였다.
Ⅴ. 미국
미국에서는 미용관련 서비스에 대해 연방차원에서 규제하지 않고, 각각의 주 정부에서 법 또는 가이드라인 형태로 관리하고 있다. 시설의 승인 및 등록, 허가, 의료서비스 제공을 위해 갖춰야할 충족요건, 특정 의료행위 및 시간의 제한 등의 주요 내용이 포함되어 있다. 상대적으로 의료에 대해 엄격한 관리를 하는 주에서 주도적으로 가이드라인 발간 및 개정하고, 그 외 다른 주 정부에서는 이를 차용한다.
가이드라인에서 다루는 내용은 수술의 복잡성과 마취의 등급에 따라 정도가 달라진다. 인력부문에서는 기본적으로 갖춰야할 요건을 상세하게 설정하였다. 시설에서는 등급별 시설구분을 통해 가능한 수술과 응급상황을 대비하여 갖춰야할 의료기기 및 의약품을 정의해두었다. 환자의 측면에서도 환자의 선별, 수술계획과 동의서작성 등의 내용을 다룬다. 마취 및 수술 과정에 대한 기록사항, 응급의료서비스 및 수송계획의 수립, 감염관리 등 의원 내 수술에 대한 전반적 사항을 가이드라인에 포함하였다.
▢ 미용성형수술(시술) 이용자 안전을 위한 가이드라인 수용․개작
Ⅰ. 가이드라인 수용․개작
의원급 의료기관의 성형수술 안전 가이드라인 및 기준을 마련하기 위하여, 대한성형외과학회(2009)에서 마련한 ‘성형수술 환자를 위한 환자안전 권고문’을 기반으로 수술진행과정에 따라 기존 문헌을 참고하여 세부사항들을 수용․개작하였다.
본 연구의 가이드라인 수용․개작의 원칙과 절차의 방향성은 세계보건기구(WHO)에서 제시한 ‘수술 안전을 위한 가이드라인의 개발방법’을 활용하였으며(WHO, 2009), 각 단계별 세부사항은 질 지표의 가이드라인 개발방법론(Thomas et al, 2012)과 수술 진행단계와 수술환자의 안전활동 범주는 임상분야 프로토콜 개발과 적용에 관한 기존 문헌들(Card, R., et al, 2014; 이형숙, 2011; 송미옥, 2009) 등을 참고하여 적용하였다.
미용성형수술(시술) 가이드라인의 수용․개작 절차는 다음과 같이 총 8단계로 진행되었다. 1단계는 미용성형수술 관련 핵심 이슈 규명, 2단계는 근거기반 구조적 문헌고찰 및 수기검색 수행, 3단계 적용 가능한 근거 검토, 4단계 근거 등급에 따른 가이드라인 세부사항 개발, 5단계 핵심이슈별 권고 및 근거 정리 및 가이드라인 초안 작성, 6단계 가이드라인 합의 및 외부전문가 의견수렴, 7단계에서는 가이드라인 최종안을 도출하였으며, 마지막 8단계는 가이드라인 확정 및 확산 전략방안을 마련하였다.
미용성형수술(시술) 가이드라인의 환자안전을 위한 기준을 마련하기 위하여 핵심이슈를 확정하고 핵심질문에 기반하여 PICOST를 설정하여 구조적 문헌검색과 수기검색 방법을 활용하였다. 환자안전을 위한 주요항목별 핵심이슈들은 임상전문가 의견을 반영하여 최종확정하였으며, 국내 적용가능성을 높이기 위하여 기 개발된 환자안전 관련 프로토콜과 수술실 지침의 내용들을 참고하였다. 또한, 수기검색을 통해 확보된 최종 선정된 24편의 문헌에서 수술과 관련된 가이드라인 내용들을 검토하여 반영하였다. 핵심이슈별 권고 및 근거를 정리하여 가이드라인 초안을 작성한 후 국내 의원급 환경에서의 미용성형수술(시술)을 진행할 경우의 적용 가능성을 고려하고 임상의 실제 사항들을 반영하고자 외부참여연구진의 검토와 각 성형외과 임상분야 전문가를 대상으로 총 2차례의 항목수정 및 보완절차를 진행하였다. 초안을 완성한 후, 대한성형외과 유관학회에 초안공문을 전달한 후 공식적인 의견접수와 수렴절차를 진행하여, 최종안을 도출하였다. 최종 도출된 가이드라인은 시설 및 환경분야와 수술과정(전, 중, 후)으로 구분하여 제시하였으며, 임상활용도를 높이기 위하여 각종 진행과정 상의 체크리스트와 환자사정을 위해 필요 의무서식 등을 포괄하였다.
또한, 최종 도출된 미용성형수술(시술) 가이드라인의 확산을 위하여 전체 유관기관 및 관련 전문가들을 대상으로 토론회를 진행하였으며, 환자안전을 위한 미용성형수술(시술) 가이드라인 최종안 확산을 위한 전략들을 모색하고 활용방안들을 마련하고자 하였다.
Ⅱ. 가이드라인(안) 수용성 분석
미용성형수술(시술) 이용자 안전을 위한 가이드라인 및 기준 마련을 위해 미용성형수술(시술)을 시행하는 의원 30개소에 근무하는 의사를 대상으로 의료기관의 개설 및 시설현황 조사와 전문가의 환자안전 인식, 미용성형수술(시술) 관련 가이드라인(안)에 대한 수용성과 필요성에 대해 조사하였다.
전문가의 환자안전 인식도 조사에서는 환자안전 관련 활동 수행이 적절하게 이루어지고 있는 것으로 조사되었으며, 성형수술(시술) 시에 환자안전과 치료결과에 가장 큰 영향을 주는 요인은 의료인의 전문성 및 숙련도, 수술(시술)과정에서 안전 가이드라인의 이행으로 나타났다. 발생 가능한 성형수술 안전문제의 개선을 위해서는 한국적 상황을 고려한 환자안전 가이드라인 마련, 전문인력의 자격요건 및 유지 보수교육 규정 마련, 의료사고 및 부작용 보고 시스템 정립 등이 필요한 것으로 나타났다. 환자안전 가이드라인(안)에서 시설 및 환경 관련 기준 개발 시 응급상황, 감염예방 수술 기구 관리, 의료인 기준, 수술실 등의 기준이 필요하다는 응답이 많았다.
전문가 검토 및 합의과정을 통하여 수용․개작된 가이드라인의 초안에 대해 의원급 의료기관에서의 필요성과 수용성을 조사하였다. 설문조사의 결과로는 시설 및 환경 가이드라인에 대한 문항의 신뢰도는 필요성이 0.919, 수용성이 0.900이었으며, 필요성의 평균은 3.81, 수용성의 평균이 3.61이었다. 수술 진행과정에서는 수술 전의 신뢰도는 필요성이 0.969, 수용성이 0.964이었으며, 필요성의 평균은 3.97, 수용성의 평균은 3.75이었다. 수술 중의 신뢰도는 필요성이 0.963, 수용성이 0.954이었으며, 필요성은 4.17, 수용성은 4.04이었다. 수술 후 신뢰도는 필요성이 0.946, 수용도가 0.933이었고, 평균은 필요성이 4.05, 수용성이 3.84이었다.
▢ 고찰 및 결론
본 연구는 미용성형수술에 국한하여 의원에서의 활용을 전제로 수술 안전을 위한 기준의 검토와 가이드라인(안)의 수용․개작을 목적으로 수행되었다. 국가별로 미용성형수술 관련 의료인 및 의료기관의 관리방식은 다양하나 무엇보다 환자의 안전을 가장 우선에 두고 자발적인 노력을 통한 교육 및 훈련 등의 강화가 공통적 사안인 것으로 확인되었다. 이에 따라 보건의료 인력의 자격요건을 강화하기 위한 각종 교육 프로그램에 대한 상세 사항은 추가적인 노력을 통해 개발될 필요가 있다.
수술의 환자안전을 향상하기 위한 가이드라인은 수술 시행에 있어서 의료인이 주의해야 할 가장 기본적인 항목에 해당한다. 본 연구에서는 수술 일반의 안전기준을 토대로 성형수술 관련 규정 및 문헌에서 언급하고 있는 근거를 문헌검색을 통해 제시하고 성형수술 관련 전문가들이 재검토하여 동의하는 방식으로 마련된 것이다. 따라서 근거수준과 관련 문헌검색을 보다 세밀하게 수행하여 일반적인 가이드라인의 수용개작 과정과 그 깊이에 있어서 차이가 있을 수 있다.
의원을 대상으로 가이드라인에 대한 수용성을 조사할 때 서울지역에만 국한하여 조사한 한계가 있다. 대부분 성형외과가 밀집해있는 서울의 강남 지역이 주요 대상이 되어 전국적인 내용으로 일반화하기에는 한계가 있을 수 있다. 또한 협조 가능한 전문가를 중심으로 조사가 진행되어 일반적인 미용성형수술 시행 의사의 수용성과도 차이가 있을 수 있다. 다만, 일부에 국한된 조사이기는 하나 가이드라인의 필요성과 수용성에 있어서 비교적 일관된 결과를 보여 조사의 신뢰도는 상대적으로 높다고 할 수 있다.
▢ Introduction
1. Background
A recent SNS (Social Networking Service) analysis on the interest regarding healthcare safety from the healthcare consumers’ perspective indicated that cosmetic services and out-of-pocket money services took high priority (Kim S et al, 2014). The sevices included double-jaw surgery, dental implants, laser eye surgery, orthodontic treatment, non-surgical rhinoplasty with botulinium toxin, propofol anesthesia, filler injection, liftings, and tattooing Cosmetic surgery is a typical example of health care not covered by national health insurance. In addition, cosmetic surgery adverse events including injuries and death of patients are frequently reported by the media and it made the social concern high. Accordingly, in September 2014, Korean Ministry of Health and Welfare conducted a survey of clinics that perform cosmetic surgery and proposed measures to enhance surgery safety in clinics.
Compared to the degree of controversy in society surrounding safety associated with cosmetic surgery, the safety mechanisms regarding this issue are relatively weak. In particular, because plastic surgery conducted for cosmetic purposes is categorized as uninsured medical procedures that are not treated as essential either for disease treatment or improved physical function; therefore, proper management within the health care system has not been achieved adequately. Furthermore, while it is estimated that the majority of such procedures are performed at clinics, the limited amount of accessible data sources has caused difficulties in identifying the status and the side effects of cosmetic surgery. Therefore, in order to enhance the safety of cosmetic surgeries that typically occur in clinics, reviewing the relevant standards and providing criteria for a safe procedure remain essential tasks. Especially, the need to explore management measures for patient safety regarding medical practices that are typically conducted at general clinics is significant at this point as the Patient Safety Act is being enacted. In addition, efforts need to be implemented that strengthen the establishment of a basic safety measures foundation regarding cosmetic surgery cases performed in medical institutions.
2. Research Objectives and Methods
Our goal in this study was to establish a foundation to improve patient safety by providing standards and guidelines for the surgeries conducted in medical institutions, staring with cosmetic surgeries, addressing specific issues have been raised by public concern. To ensure safety for users of cosmetic surgery, we identified possible safety issues expected to exist throughout the overall surgery process.
To achieve this goal, this study collected data on guidelines and policy measures related to the management of cosmetic surgery from different countries and conducted interviews with relevant officials. The analysis was conducted around the same categories as much as possible in consideration of the differences among national systems to increase data comparability. The categories included the following: the workforce related to cosmetic surgery (qualifications, etc.), facilities (standards for the operating room, etc.), patients (minors, providing information, and consent), medical advertising, and compensation for damages.
The World Health Organization (WHO) guidelines for safe surgery (2009) were used to develop the cosmetic surgery safety guidelines. Moreover, the methods for the guideline-based development of quality indicators (Thomas et al, 2012) were referenced for details during each stage, as was the protocol development method for clinical safety management (Lee, 2011). Furthermore, the surgical procedures details were based on the patient safety advisory for plastic surgery patients provided by the Korean Society of Plastic and Reconstructive Surgeons (2009).
A search of preceding literature related to the guidelines was conducted by the researchers, and the proposed guideline based on the collected data was written under the review and consultation of 10 advisors who were recommended by each professional society. Furthermore, a discussion forum was implemented to collect opinions from individuals from various fields to develop the guidelines and application plan.
▢ Regulations and Management Measures of Cosmetic Surgery in Foreign Countries
1. France
France established cosmetic surgery-related legislations in 2003 that are currently enacted. In France, doctors who are allowed to perform plastic or cosmetic surgeries are limited to specialists in plastic surgery, medical specialists in another field, or a medical specialist in another field with plastic surgery qualifications. In addition, the specialty fields that can perform plastic surgery are limited, and only cosmetic surgeries limited to the medical specialties on the association list can be performed. Facilities must receive Haute Autorité de santé certification and requirements such as facility divisions, space configurations, an observation room, and facility equipment regulations are specified. Patients must wait a minimum of 15 days after consultation to decide on the surgery, and this consideration period cannot be reduced. If the surgeon who meets the patient will not perform the entire process of the scheduled surgery (or a certain process), then the surgeon must notify this fact to the patient during the consultation, and this information must be indicated on the estimate sheet.
2. Singapore
In 2008, Singapore established “guidelines on aesthetic practices for doctors” at a major medical society meeting that has been implemented ever since. Singapore has classified cosmetic procedures and surgeries into two lists: A and B. This classification was based on scientific evidence and has determined factors such as the number of requires on the pre-procedure, a suitable environment to conduct the procedure, and minimum skill requirements according to the type of procedure. List A consists of the cases with a high level of scientific evidence or cases of well-established surgical procedures acceptable in consensus among medical experts. List B consists of the cases with a low level of evidence or procedures that have not been established and medical experts cannot arrive on a consensus as to whether they are acceptable. Practitioners of list A procedures that have a higher invasive degree are limited to surgeons or plastic surgeons, and clinic-level facilities must be equipped with operating rooms. Moreover, the guidelines ensure the billing of the appropriate costs to the patient, and advertising procedures included on list B are prohibited.
3. The United Kingdom
The United Kingdom regulated factors such as recommended personnel and facilities for cosmetic surgery. The current legal conditions to become a surgeon in the United Kingdom are the completion of five years of Medical School, along with a F1 process. Furthermore, the establishment of the Cosmetic Surgery Inter-specialty Committee consisting of professional organizations and representative societies such as the society of plastic surgery, otorhinolaryngology, oral and maxillofacial surgery, ophthalmology, mammoplasty, and gynecology has been recommended to increase professionalism in the surgical staff. Institutions practicing cosmetic surgery must register their facilities and procedures with the Care Quality Commission as that of a “general medical institution.” Advertisements related to cosmetic surgery undergo the same regulations for the Advertising Standards Authority that oversee advertising in all media outlets. Furthermore, standards are suggested for misleading advertisements related to cosmetic surgery.
4. Australia
The Australian government introduced a national registration and approval system for medical specialists in 2009, and afterwards, published the “Cosmetic Medical and Surgical Procedures: A National Framework-Final Report,” which is an official document that analyzes and regulates the cosmetic surgery field. Through the development of the “Good Medical Practice: A code of conduct for doctors in Australia,” the country strengthened regulations on the workforce in regards to medical procedures and cosmetic surgery, and regulated the mandatory responsibility of post-treatment after cosmetic surgery. Furthermore, Australia strengthened regulations on facilities through a regional licensing system, and enhanced legal regulations on advertising and compensation for damages by indicating duties and responsibilities to the patients through issuing guidelines and recommendations and showed an effort in recognizing the cosmetic surgery industry as a medical sector. However, the regulations of personnel and facilities only apply to healthcare professionals who have registered through the professional registration and approval system, and it has been indicated that the regulations on non-registered healthcare professionals are still lacking.
5. The United States
In the United States, cosmetic services are managed through the laws and guidelines established by the state governments, rather than implementing regulations at the federal level. The main components of the regulation are factors such as the approval and registration of the facility, authorization, meeting requirements to provide medical services, as well as restrictions on specific medical practices and time. Some states that enact a relatively strict management of medical treatment directly publish and revise the guidelines, and other states can reference said guidelines.
Details covered by the guidelines vary according to the complexity of the surgery or the degree of anesthesia used. In addition, the workforce sector specifies in detail the basic requirements to satisfy. The facility guidelines define the necessary medical equipment and medicines to stock in order to perform a surgery or in case of an emergency. In addition, details such as selecting a patient, planning the surgery, and signing the agreement are covered. Furthermore, the guideline includes general information about surgeries at the clinic such as keeping records on the use of anesthesia and the surgical procedure, the establishment of emergency medical services and transport plans, and infection management.
▢ The Adaptation of Guidelines for the Safety of Cosmetic Surgery Users
1. Guideline Adaptation Process
The WHO guideline for safe surgery (2009) was used in the development of safety guidelines for plastic surgery, and the methods for the guideline-based development of quality indicators (Thomas et al, 2012) along with the protocol development method for clinical safety management (Lee, 2011) was referenced for details on each stage. Furthermore, the details of the surgical procedures were based on the patient safety advisory for cosmetic surgery patients provided by the Korean Society of Plastic and Reconstructive Surgeons (2009), through which the adaptation occurred.
The adaptation process of a guideline on cosmetic surgery occurred through the following 8 stages: stage 1, identifying the key issues related to aesthetic plastic surgery; stage 2, conducting a search of evidence-based structural literature; stage 3, examining applicable claims; stage 4, developing guideline details according to the degree of the claims, stage 5, organizing the claims and recommendations by key issues and drafting the guideline; stage 6, agreeing upon the guideline and collecting the opinions of outside experts; stage 7, writing the final draft of the guideline; and stage 8, confirming the guideline and providing strategic methods for expansion.
In order to provide a standard for patient safety in the cosmetic surgery guidelines, key issues were determined and PICOST was set based on the key questions, and the structured literature search method was applied. Final confirmation of the key issues in each major category of patient safety was determined while considering the opinions of clinical experts. Moreover, to increase applicability in South Korea, the contents of operating room instructions and protocols developed for patient safety were referenced. Furthermore, the surgeries data related to the guidelines in 24 research papers were examined and considered accordingly. After writing a draft of the guidelines by organizing the recommendations and claims for each key issue, two rounds of revisions were performed with clinical experts in the field of plastic surgery and with the reviews of outside researchers in order to reflect the actual details of the clinical practice, as well as to consider other possibilities. After completing the draft, it was sent to the Korean Society of Plastic and Reconstructive Surgeons to proceed with the official opinion collection process, through which the final drafted was produced. The final proposed guidelines suggested to divide the facilities and environment, to divide the surgical procedure (i.e. before, during, and after), and in order to increase clinical utilization, various progress checklists and mandatory templates for the patient were included.
Furthermore, in order to spread the final proposed guideline for cosmetic surgery, a discussion forum was implemented with all related organizations and experts where we sought out the strategies for spreading the proposed cosmetic surgery guidelines for patient safety and we established ways of use.
2. An Analysis on the Acceptability of the Proposed Guidelines
To establish standards and guidelines for the safety of cosmetic surgery users, we conducted a survey with doctors working at 30 clinics that perform plastic or cosmetic surgery to collect data on the opening of medical institutions, the status of the facility, the awareness of patient safety by experts, and the acceptability and necessity of the proposed guidelines on cosmetic surgery.
It was indicated that “performing activities related to patient safety” was properly achieved by experts, and the survey results indicated that the factors that caused the most significant impact on patient safety during surgery, as well as on treatment results, were “the expertise and skills of the health professional” and “the implementation of safety guidelines during course of the surgery.” In addition, factors required for improving the possible safety issues during cosmetic surgery included establishing patient safety guidelines that consider the Korean situation, establishing provisions regarding qualifications and maintenance training for the professional workforce, and establishing a reporting system for medical malpractice and adverse events. Regarding the development of standards related to facilities and environment in the proposed guideline, the most frequent answers included the standards for emergencies, infection prevention, management of surgical instruments, standards for medical personnel, and the operating room.
We investigated the necessity and acceptability of the guidelines in the clinic that was adapted through review of experts and consensus of professionals. The results indicated that the item reliabilities of the “facilities and environmental guidelines” showed a necessity at 0.919 (average = 3.81) and an acceptability at 0.900 (average = 3.61). For the surgical process, the reliability of “pre-surgery” revealed a necessity at 0.969 (average = 3.97) and an acceptability at 0.964 (average = 3.75). The reliability of “during the surgery” had a necessity at 0.963 (average = 4.17) and an acceptability at 0.954 (average = 4.04). Lastly, the reliability of the “post-surgery” had a necessity at 0.946 (average = 4.05) and an acceptability at 0.93 (average = 3.84).
▢ Discussion and Conclusion
This study was conducted with the purpose of adapting the proposed guidelines and reviewing standards limited to cosmetic surgery assumed used at clinics. The management approach of medical personnel and institutions related to cosmetic surgery varies by country. However, both placing high priority on patient safety and enhancing education and training through active efforts were identified as common factors. Therefore, it is necessary to develop further details on various education programs for enhancing the requirements of personnel.
Guidelines for improving the safety surrounding a surgery correspond to the most basic notion that medical personnel must consider when performing a surgery procedure. In this study, the claims mentioned in literature and regulations related to cosmetic surgery based on the safety standards of general surgery were secured through a search on preceding literature and then presented. They were then reevaluated by experts and related with cosmetic surgery to be provided in an agreeable manner. Therefore, there might be a difference in the depth between the presented process and the general guideline adaptation as the latter involved a more detailed search of the literature related to the level of evidence.
A limitation of this study is that the survey conducted on guidelines acceptability was limited to Seoul, South Korea. Since the Gangnam area in Seoul, where clinics that perform cosmetic surgery are located, was the main location in this paper, the results cannot be generalized nationwide. In addition, because the survey was conducted with experts who were available to cooperate, there can be differences in the level of acceptability with general doctors whom perform cosmetic surgery. Although, the research is in part limited, a relatively consistent result was presented when comparing the necessity and acceptability of the guideline; therefore, the reliability of the survey is relatively high.
