▢ 연구 배경
: 문신은 외상문신, 서화문신, 미용문신, 의료문신 등으로 나눌 수 있다. 우리나라에서 문신은 의료행위의 일종으로 간주되어 의료인이 아닌 사람이 문신 시술을 한 경우 의료법에 위반에 해당한다. 하지만 서화문신은 비의료인인 문신 시술자가 시술하는 경우가 많아 서화문신에 대한 합법화, 제도화 요구가 2007년부터 꾸준하게 있었다.
▢ 연구 목적
본 연구의 목적은 1) 구조적 문헌고찰을 통하여 문헌으로 보고된 문신 유해사례를 종류, 양상, 원인 등에 따라 유형화하고, 2) 주요 국가의 문신업 관리 규정을 분석하여 문신업자/문신업소 자격 및 관리규정, 염료의 관리규정과 이외 문신과 관련된 규정을 검토하며, 3) 인터넷 기반 설문조사를 통해 국내 문신 시술자의 현황을 알아보아 서화문신행위 실태 파악을 위한 기초 자료를 마련하고자 하는 것이다.
▢ 연구 방법
문신의 유해사례 검색을 위하여 구조적 문헌 고찰 방법을 차용하여 수행하였다. 검색 대상 데이터베이스는 국외 3개 데이터베이스와 국내 7개 데이터베이스를 선정하였다. 미국, 프랑스, 일본, 대만, 필리핀 등의 문신 시술자․문신업소 관련 규정과 염료 규정, 이외 미성년자 관련 규정 등을 검토하였다. 선행 연구를 바탕으로 설문지를 개발한 후 예비 설문조사를 수행하여 설문 내용을 수정하였다. 인터넷 기반 데이터베이스를 활용하여 익명으로 설문조사를 수행하였다.
▢ 연구 결과

Ⅰ. 구조적 문헌 고찰
서화문신, 미용문신, 의료문신 등 문신으로 인하여 발생할 수 있는 유해사례를 체계적으로 검색하여 유형화하였다. 국내 17건, 국외 60건의 문헌이 선택되었다. 유해사례는 발적․통증/감염/면역 관련 질환/신생물(암)/기타로 유형화하였다. 감염은 박테리아 등의 급성 감염 및 B형 간염, 인간면역결핍 바이러스(Human Immune Virus, HIV), 매독 등의 만성 감염이 있었다. 면역 관련 질환으로는 거짓림프종, 유육종증(sarcoidosis), 육아종 등이 보고되었다. 신생물(암)에 해당하는 유해사례로는 편평세포암, 흑색종 등이 있었다. 이외 색소침착, MRI(magnetic resonance imaging) 검사 시 상호작용으로 인한 신호 없음 등이 보고되었다. 문헌으로 가장 많이 보고된 유해사례는 면역 관련 질환이다.
유해사례의 원인이 명확하게 보고된 경우는 많지 않았다. 박테리아에 오염된 염료, 염료 내 중금속, 바늘의 반복사용, 비위생적인 시술 환경, 숙련되지 않은 시술 등으로 원인을 추정하였다.
Ⅱ. 국외 규정 검토
미국, 프랑스, 일본, 대만, 필리핀의 규정을 검토하였다. 문신 관련 규정은 크게 문신 시술자․문신업소 규정, 위생 규정, 미성년자 문신 금지 규정, 염료 규정 등으로 나눌 수 있다. 미국에서는 염료 규제는 FDA(Food and Drug Administration)가 담당하는데, 지금까지 FDA가 승인한 문신 염료는 없었다. 문신 시술자․문신업소 규정․위생 규정․미성년자 문신 금지 규정은 주법으로 규정하였다. 유럽 연합에서는 2008년 문신용 염료에 포함되어서는 안 되는 물질의 목록을 발표하였고 이에 따라 유럽 각 국가에서도 문신용 염료 규정을 신설하는 추세이다. 프랑스에서는 문신 관련 규정이 2008년 신설되었는데, 문신업자․문신업소 규정, 위생 규정, 미성년자 문신 금지 규정, 염료 규정을 모두 포함하였다. 일본과 대만은 문신 관련 규정이 없었다. 일본에서는 문신을 의료행위로 간주한다. 대만은 문신을 서비스 계약의 일종으로 보아 법적 의사결정권이 없는 미성년자에 대한 문신은 금지하였고, 문신 시술자 자체 위생교육을 실시하였다. 필리핀은 문신 시술자․문신업소 규정, 위생 규정, 미성년자 문신 금지 규정이 존재하였고, 임신부 등 문신을 받을 수 없는 사람을 법적으로 제한하였다.
Ⅲ. 문신 시술자 대상 설문조사(Tattooist Survey)
2014년 8월 8일부터 8월 17일 까지 10일 간 한국타투인협회(Korea Tattoo Artists Association, KTAA)와 한국타투협회(Korea Tattoo Association, KTA) 협조로 문신 시술자 대상 인터넷 기반 익명 설문조사를 진행하였다. 설문조사에는 문신을 배우게 된 동기 및 교육 내용/문신 업태 등이 포함되었으며, 총 1,004명이 참여하였다. 이 중 538명이 설문조사를 완결하였고, 설문조사 완결자 중 설문조사에 참여하지 않겠다고 응답한 1명을 제외한 537명을 분석하였다.
문신을 배우게 된 동기는 예술성 위주의 관심이 대부분이었다(67.4%). 문신은 기존의 국내 문신 시술자에게 도제식 수업을 받은 경우(71.0%)와 독학으로 문신을 배운 경우(15.1%)가 대다수였다. 1회용 폐기물을 일반쓰레기로 처리(47.9%)하는 등의 위생 문제가 있었다. 안전한 문신 시술을 위한 요건으로 자격 관리 등 양성화 요구(33.0%)외에 안전관리 규정 마련(27.2%)과 위생관리 교육(14.9%)에 대한 응답도 많았다.
▢ 결론 및 정책적 제언
문신은 피부를 뚫고 색소를 주입하는 침습적인 행위이므로 유해사례가 수반되기도 한다. 따라서 다수의 국가에서 문신과 관련된 유해사례 발생을 최소화하기 위하여 여러 가지 형태로 문신업을 관리하고 있다. 문신 시술자․문신업소 자격 관리, 위생 관리, 염료 관리, 미성년자 문신 금지 등의 안전 관리가 이루어지고 있었다.

▢ Background
Tattoos are classified as traumatic tattoos, decorative tattoos, permanent make up, and medical tattoos. Currently the tattooing is considered a medical practice in Korea. Thus, it is illegal for anyone other than medical practitioners to tattoo others. However, tattooists rather than medical doctors perform most decorative tattoos. Therefore, requirements for establishing tattooist licence regulations have been consecutive since 2007.
▢ Objective
We performed a pilot study. This study aimed to develop a research plan to assess the actual condition of decorative tattoos. The pilot study consisted of three parts: a structured literature review investigating adverse events, a review of tattoo regulations/legislation in foreign countries, and a survey of tattooists.
▢ Methods
We used a structured strategy to perform a literature review. Specifically, three domestic and seven international databases were selected for inclusion in the literature search. Additionally, tattoo-related regulations/legislation in the United States, France, Japan, Taiwan and the Philippines were reviewed. Based on interviews with tattooists, a survey questionnaire was developed. Subsequently, an anonymous web-based survey was conducted.
▢ Results
⦁ Tattoo-related adverse events involved redness/pain, infection, immune-related diseases, and neoplasm.
⦁ Tattoo regulations included conducting tattooist/tattoo parlor, hygiene, tattooing minors, and tattoo ink.
⦁License regulation establishment, safety regulation establishment, and sanitary education are needed.
Ⅰ. Structured review of tattoo-related adverse events
The Literature search was primarily conducted utilizing Ovid MEDLINE, Ovid EMBASE, and PubMed. Domestic databases (KoreaMed, KISS, RISS, KMbase, Korean National Assembly Library, KISTI, and the National Library of Korea) were also used. A total of 77 studies were included (60 international studies, 17 domestic studies). Adverse events were categorized into redness/pain/infections/immune diseases/neoplasms/other. Infections were divided into acute and chronic infections (e.g., hepatitis type B, human immune virus, syphilis). Immune diseases consisted of pseudolymphoma, sarcoidosis, and granuloma. Neoplasms included events such as melanoma, squamous cell carcinoma, and basal cell carcinoma. Interactions with magnetic resonance imaging (MRI) were also reported.
In most studies, the causes of adverse events were not clarified. The suspected reasons included tattoo ink contaminated with bacteria, heavy metals in tattoo ink, needle reuse, poor sanitation, and poor practitioner training.
Ⅱ. Review of tattoo regulations/legislation
We reviewed the tattoo regulations/legislation in the United States, France, Japan, Taiwan, and the Philippines. The reviewed tattoo regulations/legislation contained the following: conducting tattooist/tattoo parlor, hygiene, tattooing minors, and tattoo ink. In the United States, no tattoo ink pigments have been approved by the FDA (Food and Drug Administration). Other tattoo regulations/ legislation were state codes. On February 20, 2008, the Committee of Ministers at the Council of Europe adopted a negative list of tattoo ink ingredients (Resolution ResAP(2008)1). As result of this resolution, many European countries considered developing tattoo-ink regulations. In France, tattoo regulations were established in 2008, including tattooist/tattoo parlor regulations, hygiene regulations, prohibition of tattooing minors, and tattoo ink regulations. There were no tattoo regulations/legislation in Japan and Taiwan. Tattooing was also considered a medical practice in Japan. In the case of Taiwan, tattooing was a gray area and was deemed to a service contract. Tattooing minors was illegal because they are not perceived as capable of making legal decisions. However, the health department of the city government provided health and safety education. In the Philippines, established tattoo regulations included tattooist/tattoo parlor regulations, hygiene regulations, and prohibiting tattooing minors. Additionally, the law restricted pregnant women and others who are not allowed to get a tattoo.
Ⅲ. Tattooist survey
We performed an anonymous web-based survey for tattooists from August 8 to August 17, 2014, in cooperation with the Korea Tattoo Artists Association (KTAA) and the Korea Tattoo Association (KTA). The questionnaire domains consisted of areas such as motivations to learn how to tattoo, contents of the training course, and conditions of the tattoo business. etc. A total of 1,004 tattooists participated in the survey and data from 537 tattooists were analyzed who completed the questionnaire.
A large number of respondents replied the motivation to learn how to tattoo was sparked by artistic interest (67.4%). Most tattooists learned to practice tattooing from domestic tattooists (71.0%), and through self-education (15.1%). The major sanitary problem was the general disposal of single use waste (47.9%). Respondents also indicated that the requirements for a safer tattoo practice were establishment of a tattoo license regulation (33.0%), safety regulation establishment (27.2%), and sanitary education (14.9%).
▢ Conclusions
The practice of tattooing is invasive, and involves penetrating the skin and injecting ink pigment. Therefore, there is a possibility of adverse events. Many countries have tattoo regulations/legislation related to practicing tattooing. The regulations/ legislation consists of conducting tattooist/tattoo parlor, proper hygiene, prohibiting tattoos for minors, and contents of tattoo ink.
